Terms of Service
Effective date: 10/07/2026
We will update this policy from time to time. When we do, the “effective date” above will change and the new version will be posted here.
Summary
These terms are mainly here to prevent unjust lawsuits and scams against us. If you hire us to create a website for your business, there are a few technical details regarding payment and services in here for clarity. See sections 3, 4, and 5 for the most relevant details. We will send you a copy of these terms and any other agreements necessary for your project, written in plain English, before we begin work.
1. What these Terms cover
These Terms of Service (“Terms”) govern your use of the website [trwebworks.com] (“Site”) and any services we provide to you (collectively, the “Services”). By visiting the Site, sending us a message, or hiring us for a web‑design project, you agree to be bound by these Terms.

3. Scope of Services
- We design, develop, and deliver custom WordPress websites for small businesses in the Upstate Greenville, SC area (or elsewhere, as requested).
- Services may include: site design, coding, content migration, basic SEO, domain registration assistance, hosting setup on Flywheel (or elsewhere), and optional post‑launch support.
- Any service not listed in the written proposal or quote is outside the scope of the contract and will be billed separately.
4. Quotes, Pricing, and Payment

|---|---|---|
| Standard 5‑page website | $985 | 50 % up‑front, 50 % on launch |
| Custom website plan | “Quote on request” | 50% up-front, 50% on launch |
| Custom add-on outside original scope | “Quote on request” | 100 % before work begins (unless otherwise agreed) |
| Ongoing support/maintenance | $50/mo (optional) | Monthly in advance |
- Invoices are sent via ProtonMail (encrypted) and are payable by check, cash, or Bitcoin. Digital payments are coming very soon.
- Late payments (> 15 days past due) incur a 1.5 % per month interest charge and may result in suspension of work until payment is received.
- All payments are non‑refundable once work has commenced, except as required by the “Termination” clause below.
- (If you are unsatisfied with out work, then we’re happy to work out a refund with you. However, we issue refunds on a case-by-case basis, so there’s no concrete terms for it in here. In legal terms, we are leaving it up to our discretion. Don’t worry though; we’re honorable people and we don’t want you to pay for something you dislike or believe was underdelivered.)
5. Client Responsibilities
Essentially, you just have to agree to provide some expected details and feedback, so we can actually make a website for you.
- Provide accurate information – you must give us correct names, contact details, content, images, and any third‑party credentials (e.g., domain registrar login).
- Content rights – you must own or have a license for all content you supply (text, photos, logos, videos).
- Timely feedback – to keep the project on schedule, you must review drafts and provide approvals or requested changes within the time frames stated in the project schedule. Delays caused by late feedback may extend the delivery date without extra charge to us.
If you fail to meet any of these obligations, we may pause work until the issue is resolved.
6. Intellectual Property
- Your content – All text, images, logos, and other material you deliver remain your property.
- Our work product – Upon full payment, we transfer to you all source files, design files, and the right to use the finished website (including code, graphics, and documentation). We retain the right to showcase the site in our portfolio or marketing materials, unless you ask us in writing to keep it private.
- Third‑party tools – Any third‑party plugins, fonts, or libraries remain under their original licenses; you are responsible for complying with those licenses.
7. Warranties & Disclaimers
- We warrant that the website we deliver will function substantially as described in the project proposal and will be free of defects for 30 days after launch. During that period we will fix bugs at no extra charge.
- Except for the limited 30‑day warranty above, we provide the Services “as is” and “as available”. We do not guarantee:
- Specific search‑engine rankings or traffic levels.
- Compatibility with every browser version or future operating‑system updates.
- That the site will be completely error‑free forever.
8. Limitation of Liability
To the maximum extent permitted by law, TR Web Works, its owners, employees, and contractors shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or business opportunity).
- Any loss arising from third‑party services (e.g., Flywheel hosting outages, domain‑registry issues, payment‑gateway errors).
Our total liability for any claim arising out of or relating to these Terms shall not exceed the total amount you paid us for the specific Services giving rise to the claim.
9. Indemnification
You agree to defend, indemnify, and hold harmless TR Web Works, its affiliates, and their officers, employees, and agents from any claim, demand, or suit (including reasonable attorney’s fees) arising out of:
- Your breach of these Terms.
- Your violation of any law, regulation, or third‑party right (including copyright or trademark).
- The content you provide to us.
10. Termination
- By you – You may terminate the agreement at any time by written notice. You remain responsible for paying for all work completed up to the termination date, plus any non‑recoverable expenses (e.g., domain registration).
- By us – We may terminate if you fail to pay, repeatedly breach the Terms, or provide illegal or infringing content.
- Upon termination, we will deliver any finished assets owed to you and delete any remaining personal data within 1 week.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of South Carolina, USA, without regard to conflict‑of‑law principles. Any legal action or proceeding arising under these Terms shall be filed exclusively in the state or federal courts located in Pickens County, South Carolina, and you hereby consent to personal jurisdiction therein.
12. Changes to the Terms
We may update these Terms from time to time (for example, to reflect changes in the law or our services). The effective date at the top will be updated, and the revised Terms will be posted on the Site. Your continued use of the Site or Services after any change constitutes acceptance of the new Terms.
13. Entire Agreement
These Terms, together with any written proposal/contract you sign, constitute the entire agreement between you and TR Web Works regarding the Services and supersede any prior oral or written communications.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
